Jefferson City – Today’s revelation that Robin Carnahan illegally placed a candidate on the ballot to allow Jay Nixon to accept at least $600,000 in additional campaign contributions is shocking, but not surprising. Democrats in Missouri have made a mockery of our election laws and they have jeopardized the integrity of the upcoming election.
“Whether through turning the other cheek on ACORN fraudulent registrations and other activities, violating clear statutory language and requirements for candidate certification, or illegally using state-raised funds to assist federal candidates (http://www.mogop.org/media/obamanixon1.jpg), the Democrats in Missouri are engaging in illegal activities that call into question the integrity of our elections for all Missourians,” said Tina Hervey, communications director.
The documents linked below lay out clearly the fact that Robin Carnahan’s office violated statutory deadlines and illegally certified Jay Nixon’s primary opponent for the August election. The sole beneficiary of this illegal activity was Attorney General Jay Nixon. Clearly Missourians cannot trust Nixon to fulfill the duties he was elected to do and prosecute his co-conspirator in this sordid affair.
The statute in question states, “115.387. Not later than the tenth Tuesday before each primary election, the secretary of state shall transmit to each election authority a certified list containing the name and address of each person who has filed a declaration of candidacy in the secretary’s office and is entitled to be voted for at the primary election, together with a designation of the office for which the person is a candidate and the party the person represents. In the person’s certification, the secretary of state shall also include the order in which the candidates for each office are to be listed on the official ballot.”
The statute doesn’t state that as long as the required materials are received by the Secretary of State on the tenth Tuesday (past 10:30pm no less)…it says “the secretary of state shall transmit to each election authority a certified list…” not later than the tenth Tuesday.
In one email from the Secretary of State’s office the statement, “Rich doesn’t want to put Mr. Carroll on the ballot based on what we have received” is made the day after the certification deadline. Someone, likely Carnahan, overruled that assessment so Nixon could stay flush with campaign cash.
A county clerk observed in documents obtained through Sunshine requests that, “SOS is the filing officer and theya re (sic) the ones who will be sticking their neck out on this one.”
“There are many questions that still have to be answered regarding Robin Carnahan and Jay Nixon’s conspiracy – the voters of Missouri deserve answers,” said Hervey.
